Rules, Policies and Disclaimers

The Wargamer.com (the “Wargamer” ) message board is a place where all members can feel free to exchange ideas and discuss topics of all sorts. Our goal is to allow and to protect the opinions of our community. In order to maintain an enjoyable atmosphere for all members, guests, and participants, the following rules, policies, and disclaimers must be read,  understood and abided by. By registering for these forums, you agree to follow all rules and policies set forth below. Our mission is to protect the right of all members to express themselves, so long as the following rules are abided by.

 

Disclaimers

The Wargamer is solely responsible for creating, hosting, and maintaining this message board. However, The Wargamer’s opinions and views may not necessarily be the same as those who participate in the discussion within this message board. This is a private message board and shall not be used for anyone's personal causes.

The Wargamer reserves the right to ban any member from this message board, for causes such as the violation of any rule herein or for the overall benefit of the community. The Wargamer shall have the right, but not the obligation, to monitor the content on these forums in compliance with these Terms of Use and any other operating rules that may be established by the Wargamer from time to time. The Wargamer also reserves the right to delete or remove any post on this message board. The Wargamer also reserves the right to modify, add, or remove the rules and disclaimers herein, without prior notice.

The Wargamer does not warrant or vouch for the accuracy, completeness or usefulness of any post, thread, image, or private message. It is also not responsible for the content of any message or post. Posts express the views and opinions of the author, and not necessarily the views and opinions of The Wargamer, its affiliates, or any business/organization/person associated with The Wargamer. The Wargamer and its representatives also reserve the right to be impartial to or have no opinion of any controversial issue, debate, matter or motion that it or they see fit.


 

The Rules for The Wargamer Forums

  1. No posting of copyrighted material unless the copyright is owned by yourself, or you have clearly displayed that you have permission to use or distribute such material. This includes posting links to illegal downloads of movies, games, books and any other material that is copyrighted. No posting of serial keys for software or links to sites that participate in illegal file-sharing. This includes copyright infringement posts that allow members to evade copyright laws or use pirated software.
  2. No blatant advertisements for non-strategy/non-wargaming related products, schemes, chain letters, pyramid schemes, or solicitations. Users are allowed to include a website address in a signature, request comments on their personal site in a social setting, or provide an interesting or relevant link to another site.
  3. No trolling. “Trolling” is whenever someone is clearly and deliberately posting in a manner that appears their sole purpose is to anger and/or insult other participants of this message board. Trolling can also be posts directed not only to one member but a group of members. Trolling does not encourage further discussion. Trolling encourages personal attacks and as such will not be tolerated. No badgering or forum stalking will be tolerated.
  4. No language that is harassing, sexually harassing, hateful, racist, threatening, constitutes an invasion of a person's privacy, encourages conduct that would constitute a criminal offense, give rise to civil liability, or that otherwise violates any local, state, national or international law or regulation.  
  5. No avatars or posting of any materials including pictures, drawings and/or graphics that are: hateful, racist, displays nudity or an explicit sexual act, encourages conduct that would constitute a criminal offense, give rise to civil liability, or that otherwise violates any local, state, national or international law or regulation.  
  6. Discussion about the forum work, forum performance or disciplinary actions instilled by any forum administrator or moderator will not be tolerated anywhere within the message board. Personal attacks against administrators, moderators and/or staff will not be  permitted anywhere within the message board. Impersonating a forum administrator or moderator will also not be tolerated. Members who wish to dispute an administrator or moderator action, or have a complaint concerning an administrator or moderator, can private message the Editor-in-Chief, Szmania or send an email to editor@wargamer.com, or contact the forum moderators individually.
  7. Duplicate forum accounts are not allowed. Exceptions to this rule may be considered under special circumstances. To request a duplicate account,  contact the Administrator (Sigma One or editor@wargamer.com). Duplicate accounts that were not approved by the Administrator  will be deleted, and  actions  may be taken against the original forum account holder. If a duplicate account is approved, sock-puppeting of any kind will not be tolerated. “Sock-puppeting” is when a forum member with duplicate accounts posts within the same thread using both accounts creating the illusion that they are two different forum members, or carrying-on a discussion with oneself using two accounts. Sharing of message board accounts is not acceptable.
  8.  No foul language that would be considered abusive or “non-family”. This includes any materials that are knowingly false and/or defamatory, inaccurate, abusive, sexually-oriented, vulgar, obscene, profane, rude, hurtful, or disrespectful. The four words that are exclusively not allowed outside of the Religion & Politics forum are: a##, sh#t, f#ck, and c#nt (unless the first word is in reference to the donkey species). If used outside of the Religion & Politics forum they must be censored with special characters as seen above.
  9. No avatar/posting of any materials including pictures, drawings and/or graphics that are sexually-orientated, vulgar, obscene, or anything that would be consider “non-family”.
  10. All of the above also applies to conduct within the private messaging system.

     

 

The "Ask Publishers, Developers & Designers" Forums

Our message board has specified "Ask Forums" which allow members of our community to directly communicate with game publishers, developers & designers. They can post questions and the publisher, developer or designer will then reply. As such, the rules within these forums are more strict. Only serious questions are allowed, and under no circumstance are people to flame, name call, insult or be rude within these ask forums.

 

The “Religion & Politics” Forum

The “Religion & Politics” forum, or “R&P”, is a subforum where heated and controversial debates are  permitted. The forum can only be  viewed by those who have been provided  access. Only rules 1 through 7 above apply to the Religion & Politics forum. However, discussions about the forum work performance of the administrators or moderators will not be tolerated. Members who would like access to R&P can ask for access by contacting the Administrator via PM at Sigma One or editor@wargamer.com. You may also ask a forum moderator. Again, only rules 1 through 7 above apply to the Religion & Politics forum.

 

Message Board Disciplinary Process: Each violation will be handled according to the circumstances involved. This means, staff will use their discretion when determining any suitable disciplinary actions. Some message board violations will be met with a warning, while more severe infractions  will be followed by restriction of forum access or temporary ban/suspension. The most severe violations will be followed by an immediate permanent ban. Forum members permanently banned can ask for a pardon by sending an email to editor@wargamer.com explaining why we should issue a pardon. A pardon will only come to fruition if the Administrator and all forum moderators unanimously vote in favor of issuing a pardon. Members who wish to dispute an administrator or moderator action, or have a complaint concerning an administrator or moderator, can private message Sigma One or send an email to editor@wargamer.com, or contact the forum moderators individually.

 

Hold Harmless & Indemnification:  You agree to defend, indemnify, and hold harmless the Wargamer and its affiliates and other subsidiaries, and its respective employees, contractors, officers, directors, and agents from all liabilities, claims, and expenses, including attorney's fees that arise from your use or misuse of the Wargamer or from any breach of the Terms of Use. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

 

Limitation of Liability: YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH THE WARGAMAER IS TO DISCONTINUE YOUR USE OF THE WARGAMER SITES.  THE WARGAMER, ITS AFFILIATES AND SUBSIDIARIES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, INABILITY TO USE, OR RELIANCE UPON THE WARGAMER OR ANY POSTINGS ON THE WARGAMER. THESE EXCLUSIONS APPLY TO ANY CLAIMS FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER COMMERCIAL AND/OR CIVIL DAMAGES OR LOSSES, EVEN IF THE WARGAMER KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY, AND THE LIABILITY OF OUR SUBSIDIARIES AND AFFILIATES, SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

WE NEITHER ENDORSE OR ARE RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE OR STATEMENT ON THE WARGAMER, NOR ANY OFFENSIVE, DEFAMATORY OR OBSCENE POSTING MADE ON THE WARGAMER. UNDER NO CIRCUMSTANCES WILL THE WARGAMER BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY YOUR RELIANCE ON INFORMATION OBTAINED THROUGH EITHER THE CONTENT OR POSTING ON THE WARGAMER. IT IS YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION, OPINION, ADVICE OR OTHER CONTENT AVAILABLE THROUGH THE WARGAMER.
